Terms & Conditions

Last updated: August 11, 2026

These Terms and Conditions govern your use of the website operated by Colin C. Cushnie, P.A., doing business as Cushnie Law Group ("Cushnie Law Group," "we," "us," or "our"). By using this website, you agree to use it lawfully and consistently with these terms.

General Information; No Legal Advice

The website provides general information about Cushnie Law Group and its legal services. Website content is for informational purposes only and is not legal advice. Laws and legal outcomes depend on specific facts and may change over time. You should obtain advice from a qualified attorney concerning your individual circumstances.

No Attorney-Client Relationship

Viewing this website, submitting a contact form, sending an email or text message, calling our office, or requesting a consultation does not create an attorney-client relationship. Cushnie Law Group accepts a client only through a written engagement agreement signed by the firm and the client.

Do not send confidential or sensitive information until the firm confirms in writing that it represents you. Information sent before an attorney-client relationship is established may not be privileged or confidential and may not prevent the firm from representing another person whose interests are adverse to yours, subject to applicable law and professional rules.

Consultation Requests and Time-Sensitive Matters

A website submission does not guarantee that Cushnie Law Group will accept a matter, contact you within a particular time, or take action on your behalf. Do not rely on a website form, email, voicemail, or text message to protect a legal right or meet a filing deadline. If you face an emergency, call 911 or the appropriate emergency service.

No Guarantee of Results

Descriptions of services, prior matters, recoveries, testimonials, reviews, or other results do not guarantee or predict a similar outcome in any future matter. Every legal matter is different and must be evaluated on its own facts and applicable law.

Geographic and Professional Limitations

The website is not intended to solicit legal representation in a jurisdiction where doing so would violate applicable law or professional rules. Cushnie Law Group's ability to provide legal services depends on attorney licensing, the nature and location of the matter, conflicts, capacity, and other professional considerations.

Intellectual Property

Unless otherwise stated, website text, graphics, branding, layout, and other content are owned by or licensed to Cushnie Law Group and are protected by applicable law. You may view and make reasonable personal use of the website, but you may not reproduce, distribute, modify, publish, sell, or exploit its content without permission.

Prohibited Use

You may not disrupt the website, attempt unauthorized access, submit malicious code, impersonate another person, misuse website forms, scrape content at an unreasonable scale, interfere with security features, or use the website for unlawful, fraudulent, or abusive purposes.

Third-Party Links and Services

The website may contain links to third-party websites or use third-party services for convenience, maps, analytics, form processing, security, scheduling, or communications. We do not control those third parties and are not responsible for their content, availability, security, or privacy practices.

Website Availability and Disclaimer

The website is provided on an "as available" basis. We do not guarantee that the website will always be available, secure, accurate, complete, current, or error-free. To the fullest extent permitted by law, Cushnie Law Group disclaims warranties arising solely from website use.

Limitation of Liability

To the fullest extent permitted by law, Cushnie Law Group will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, or inability to use, this website. Nothing in these terms limits liability that cannot lawfully be limited or excludes duties arising from an established attorney-client relationship.

Mobile Messaging Terms and Conditions

These Mobile Messaging Terms apply only to people who specifically opt in to receive text messages from Cushnie Law Group.

Program Description

People who specifically opt in may receive recurring conversational and informational text messages from Cushnie Law Group. Messages may concern consultation requests, appointment scheduling, confirmations and reminders, case intake, document requests, responses to questions, and case-related updates.

This SMS program is intended for informational and customer-care communications and does not describe promotional marketing messages.

Message Frequency and Charges

Message frequency varies. Message and data rates may apply. Cushnie Law Group does not charge a separate fee for these messages, but your wireless carrier may charge message or data fees. You are responsible for charges imposed under your wireless plan.

Voluntary and Separate Consent

Participation is voluntary. Consent to receive text messages is not a condition of hiring Cushnie Law Group or receiving legal services. Providing a telephone number, submitting a consultation form, accepting general website terms, or consenting to email communications does not by itself constitute SMS consent. Website SMS consent is collected through a separate, optional checkbox that is unchecked by default.

By opting in, you represent that you are the owner or authorized user of the mobile number provided. Please notify Cushnie Law Group if the number changes or is reassigned.

Opt-Out

Reply STOP to any message to opt out. Other recognized opt-out commands may include END, CANCEL, QUIT, UNSUBSCRIBE, or OPT OUT. We may send one final message confirming the opt-out. After that confirmation, no further recurring messages will be sent unless you separately opt in again. To rejoin, complete the website opt-in process again or otherwise provide a new, documented opt-in.

Help and Customer Care

Reply HELP for assistance, call (772) 335-9219, email [email protected], or visit https://cushnielaw.com/contact.

Delivery and Security Limitations

Wireless carriers do not guarantee delivery. Messages may be delayed, blocked, unsupported, or unavailable. Carriers and messaging providers are not responsible for delayed or undelivered messages to the extent allowed by law.

SMS is not guaranteed to be secure or confidential. Do not send highly sensitive medical, financial, identification, or case information by text unless Cushnie Law Group specifically directs you to do so. Do not rely on SMS for emergencies, urgent legal deadlines, or time-sensitive instructions.

Privacy

Our collection and handling of personal information, mobile numbers, and SMS consent records is governed by our Privacy Policy at https://cushnielaw.com/privacy-policy.

Changes or Termination

Cushnie Law Group may modify or discontinue its messaging program and may update these terms by publishing a revised effective date. Silence, continued website use, form submission, or merely providing a telephone number does not create SMS consent.

Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law must apply.

Changes and Severability

We may update these terms by posting a revised effective date. If any provision is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
